1. Eligibility & Accounts
- Age requirement. You must be at least 18 years old and represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of its terms.
- Account accuracy. You must provide accurate information and keep it updated. You are responsible for your credentials and for all activity under your account.
- One person, one account. You may not share, transfer, or sell your account.
2. Services & Features
Within Social helps people meet through their networks using mutual-friend signals, profiles, messaging, and referrals. Certain features are optional (for example, contacts import and location) and can be toggled in your settings. We may add, modify, or remove features at any time.
We do not guarantee matches, dates, relationships, or any particular outcome. Any optional health-awareness fields collected during registration are entirely voluntary, are never displayed on profiles, and do not constitute medical advice or diagnosis. Always consult a qualified healthcare professional for personal health guidance.
3. Privacy
Your use of the Services is also governed by our Privacy Policy and Cookies Policy, which describe what information we collect, how we use and share data, and your choices. By using the Services, you consent to those practices.
4. User Content & License
You may post or provide content (text, photos, messages, profile information, feedback, and similar materials) (collectively, “User Content”). You retain ownership of your User Content, subject to the licenses below.
- License to Within Social. You grant Within Social a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works of, publish, display, and distribute your User Content solely to operate, improve, promote, and provide the Services.
- Feedback. Any suggestions or feedback you provide may be used by Within Social without restriction or obligation to you.
- Your representations. You represent and warrant that you own or have all necessary rights to your User Content, that your content will not violate applicable law or third-party rights, and that you have obtained any required consents.
5. Contacts Import & Referrals
If you choose to import contacts or send referrals:
- You direct Within Social to process identifiers for contacts you select to enable mutual-friend matching and referral features.
- You represent that you have a lawful basis to provide such contact information and to message those contacts.
- You may exclude or remove specific contacts at any time. See our Privacy Policy for details on processing and retention.
6. Prohibited Conduct
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose.
- Harass, threaten, stalk, exploit, or harm others; send unsolicited messages or scams.
- Post or transmit content that is illegal, involves the exploitation of minors, is non-consensual, hateful, or infringing.
- Impersonate any person or entity, or misrepresent your identity or affiliation.
- Scrape, crawl, or data-mine the Services except as permitted by robots.txt; reverse engineer or circumvent security measures.
- Use another person's account or attempt to gain unauthorized access to the Services.
- Interfere with, disable, damage, or overburden the Services or their infrastructure.
- Use the Services for commercial solicitation without our prior written consent.
7. Safety, Moderation & Enforcement
We provide tools to report and block users and content. We may review and moderate content using a combination of automated systems and human review, and we may remove content or suspend or terminate accounts that violate these Terms or our policies.
We do not conduct criminal background checks on users and cannot guarantee the identity or conduct of any user. Please exercise caution when deciding what information to share and when meeting others in person.
8. Subscriptions, Purchases & Billing
Certain features may require a paid subscription. Purchases are processed through the Apple App Store or Google Play Store.
Automatic Renewal Notice
All subscriptions automatically renew for the same duration at the then-current price (plus applicable taxes) unless you cancel at least 24 hours before the end of the current billing period.
- Billing. Your Store account will be charged at confirmation of purchase per the applicable Store terms.
- How to cancel. Cancel via your device's Store account settings at least 24 hours before the renewal date.
- iOS: Settings > [Your Name] > Subscriptions
- Android: Google Play Store > Profile Icon > Payments & Subscriptions
- Trials. If offered, free trials convert to paid subscriptions unless canceled before the trial period ends.
- Refunds. Except as required by applicable law or the Store's refund policies, all purchases are final and non-refundable.
- We may change pricing or introduce new paid features with notice where required by law.
9. Intellectual Property
The Services, including software, logos, designs, and content (excluding User Content), are owned by Within Social or our licensors and are protected by applicable intellectual property laws. No license is granted to you except as expressly set forth in these Terms.
- Trademarks. “WITHIN,” “WITHIN SOCIAL,” our logos, and associated marks are trademarks of Within Social, Inc. You may not use them without our prior written permission.
- Proprietary technology. Our matching technology and related processes are proprietary. Unauthorized use, reproduction, or reverse engineering is prohibited.
10. Third-Party Services & Links
The Services may integrate or link to third-party services. We are not responsible for any third-party services, which are governed by their own terms and privacy policies. Your use of such services is at your own risk.
11. App Store Terms
If you download the app from the Apple App Store or Google Play Store, you also agree to the applicable Store terms. The Store provider is not a party to these Terms and is not responsible for the Services.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. In the event of failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHIN SOCIAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PARTICULAR RESULT OR OUTCOME WILL BE ACHIEVED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHIN SOCIAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
Aggregate Liability Cap
Our total aggregate liability shall not exceed the greater of one hundred U.S. dollars ($100) or the amounts you have paid us (if any) in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusions or limitations above; in those jurisdictions, they apply to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Within Social and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.
15. Termination
You may stop using the Services at any time. We may suspend or terminate your access immediately if you violate these Terms or our policies, or for security, legal, or operational reasons. Upon termination, your rights under these Terms end. Provisions that by their nature should survive termination (including intellectual property, disclaimers, liability limitations, and arbitration) will remain in effect.
16. Changes to the Services or Terms
We may modify the Services and these Terms at any time. If changes are material, we will provide reasonable notice (for example, via in-app notification or email). Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
17. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
- Governing law. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
- Binding arbitration. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding arbitration administered by JAMS under its Streamlined Rules. Arbitration will take place in Delaware (or by video/teleconference if both parties agree). The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
- Class action waiver. All disputes must be brought in an individual capacity. You waive the right to participate as a plaintiff or class member in any class, collective, or representative proceeding.
- Exceptions. Either party may bring qualifying claims in small-claims court or seek injunctive relief in court for intellectual property misuse.
- Opt-out. You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to legal@withinsocial.com with your name, account email, and a clear statement of your wish to opt out. If you opt out, the venue and governing law provisions still apply.
18. Copyright Infringement (DMCA)
If you believe content on the Services infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act to legal@withinsocial.com including:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification and location of the allegedly infringing material.
- Your contact information (address, phone number, email).
- A statement that you have a good-faith belief the use is not authorized.
- A statement, under penalty of perjury, that your notice is accurate and you are authorized to act on behalf of the copyright owner.
We may remove infringing content and terminate the accounts of repeat infringers.
19. Communications & E-Sign Consent
You agree to receive service-related electronic communications from us (for example, security alerts, legal notices, and account updates). Marketing messages are optional and include unsubscribe instructions. By using the Services, you consent to electronic communications and agree that they satisfy any legal requirement for written communications.
20. General Provisions
- Entire agreement. These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Within Social regarding the Services.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- No waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Force majeure. We shall not be liable for any delay or failure in performance due to events beyond our reasonable control.
21. California Subscriber Rights
If you are a California resident, the following additional provisions apply:
- Right of cancellation. You may cancel your initial subscription without penalty or obligation within three (3) business days from the subscription date by contacting the Store through which you subscribed.
- Automatic renewal disclosure. In accordance with California law, automatic renewal terms are disclosed before you subscribe, as detailed in Section 8 above.
- Consumer privacy. For information about your rights under the California Consumer Privacy Act (CCPA), please review our Privacy Policy.
